OPTIMIZATION OF ANALYTICAL METHOD FOR CALCULATING THE WEAR OF BUILDINGS

The dissertation focuses on the problems associated with determining the amount of wear (finding the remaining technical values) that are being addressed. It deals with an overview of the different methods used. The basic premise of the thesis is a comprehensive overview of the calculation procedure and the methods used. This area of wear does not except the price regulation precisely defined procedure, nor are they addressed the circumstances in which that would be the method to be used. Various possible methods or inaccuracies may result in questioning the expert opinions as at trial. In conclusion of this dissertation is shown how the calculation procedure should wear for what purpose should be used and it is also proposed several alternatives.

INSTITUTIONAL ASPECTS OF EXPERT ACTIVITY

The thesis analyzes an expert in social (institutional) relations that constitute the organizational and institutional background of Forensic Expertise as part of forensic engineering. The work explains the terminology and definitions used, with the greatest attention is paid to the analysis of the conditions for the exercise of expert activities from different perspectives (in particular legal and economic). Is discussed in detail in particular the status of expert institutes, and in all contexts: both in terms of expertise and its guarantee, as well as in terms of responsibility processors appraisal institute. Further describes the work of existing associations and experts estimated their future development. An important part of the work is a comparison of the conditions for the exercise of expert activities (advantages and disadvantages) in selected European countries: Slovak Republic, England and Austria. Based on the findings in the final section are designed and justified by changes in the conditions and rules for the performance of expert activities and other related aspects.

VALUATION OF DAMAGED, UNLICENSED AND UNAUTHORIZED BUILDINGS

This PhD thesis analyzes the current, by experts in minimum benchmark solved condition of valuation of damaged, unlicensed and unauthorized buildings, it defines the problematic status of the individual administrative areas where the expert report is the decisive evidence and it recommends suitable method of valuation of these buildings, so as to minimize the risk of bringing faulty expert opinion. The paper not only explains the basic concepts identified in the relevant legislation, but also systematically analyzes the possible ways of determining the usual price of mentioned buildings. Derived ways of valuation methods are validated on examples and evaluated. On the basis of this verification there is a recommended procedure to determine the usual price of these types of buildings, ie. the expert standard.

Expert witness - psychologist in criminal trial

anglicky The aim of this diploma is to describe the role of an expert psychologist witness in criminal trial and to define purpose of forensic psychological assessments. It also tries to answer current questions related to the field of psychological expert opinions. The psychological forensic expert witness is appointed in the same way as other legal expert witnesses. That means he has the same rights and obligations as them. The first chapter is therefore devoted to connoisseurship in general. It deals with the historical development of expert witnesses, current applicable legislation and upcoming legislative changes in this area. The second chapter approaches other expert witnesses in court too. It includes number of forensic experts in various fields and compares expert psychologists to psychiatrists, who often provide their opinions alongside psychologists'. The main part of the chapter is left to expert opinions. It clarifies terms such as personality, intellect, memory, motivation and dangerousness of the offender, that are the most commonly evaluated aspects. Conclusion of second chapter summarises the expert opinions in selected EU countries and the USA. The final chapter is devoted to the expert report as evidence in criminal proceedings. The psychology of murder

The main concern of this thesis is to describe the motivation of the offender of murder and psychological background of this extremely aggressive antisocial act. The whole work was conceived from the perspective of expert's witness work. It draws mainly on the knowledge of forensic psychology, as well as other border areas. It is based on a total of processing 38 expert witness statements of accused murderers. In this set, Schlesinger's concept of criminal motivation was applied by using a simple methodology. The aim was to verify whether it is possible to determine the nature of motivation. Also used was the opportunity of causal assessment recidivism, and compared the responses with expert witness's opinion if they were comparable. Both hypothesis were confirmed on significance level α = 0,05. Since this is a relatively unique set of explorands with high proportion of homicide offenders active in organized crime and hired killers, there were compiled descriptive statistics of the tested group, which was divided subsequently into two smaller criterion: murder by organized crime. Comparative analysis of the regulation of certified translation and interpreting in Czech Republic and in France

The main aim of this bachelor thesis is comparison of the Czech and French legal regulation concerning court translation and interpretation and the analysis of the relevant legal terminology. Comparison is based on finding parallels and differences between above mentioned legal regulations. Thesis is systematized into five main chapters and then further to the subchapters. The first chapter is general characteristic of translator and interpreter and also court translator and interpreter. The second chapter is analysis of the relevant Czech legal regulation, which leads me to follow-up description of interpreter's rights and duties in the Czech Republic. The third chapter is similar to the second one, but it aims on French legal regulation. The main comparison of both legal regulations is involved in the fourth chapter. The fifth chapter contains French-Czech glossary and analysis of the legal terminology related to court translation and interpretation.
